San Ramon lawyer busted in Dublin hit-and-run death

A San Ramon man has been arrested in the hit-and-run death of a bicyclist on May 15 in Dublin.
A news release from the Dublin Police Department said attorney Spencer Freeman Smith, who lives in San Ramon but practices law in San Francisco, was arrested the night of May 17.
Smith was arrested for vehicular manslaughter and felony hit and run in the Tuesday night crash that killed Bo Hu, 57, also of San Ramon. Hu, who was either walking his bike or riding northbound on Dougherty Road near Fall Creek Road, was pronounced dead at the scene.
"At the time of the accident, our officers responded and they collected three vehicle parts that were left at the scene," said Lt. Herb Walters. "Each part has a serial number on it. They found that it belonged to a Mercedes."
Walters said officers then went to a Mercedes dealership, which tracked the numbers down and determined they came from a black 2012 Mercedes-Benz CLS550.
"We asked them if they'd sold any 2012's and they said, 'Well, we can't tell you without a court order,'" Walter said.
While waiting for the court order, he said police received calls from people who said they'd seen a similar vehicle in San Ramon.
Walters said they who their suspect as soon as they got the list from the dealership.
"We called him, and he says, 'I'll be there in 20 minutes.' It turned out to be an hour and a half and he showed up with his attorney," Walters said.
A search warrant at Smith's home showed the car, with extensive front end and windshield damage. Walters said the damage matched the parts recovered at the scene.
The Mercedes was towed from Smith's home to the crime lab at the Alameda County Sheriff's Office for further examination.
Smith was booked at Santa Rita Jail but has since been released on bond.

Mr. Smith is obviously innocent until proven guilty but, if he were my attorney on a current case, I'd for sure be considering fall-back options in the event of his conviction.
Given the incident time of 11:30 pm there are pretty good odds that the driver had been drinking. Which may explain (but obviously not excuse) his reluctance to stop. Be interesting to know if his credit card receipts showed any alcoholic beverage purchases over the course of the evening...

Posted by LMP, a resident of the Danville neighborhood, on May 22, 2012 at 6:49 am There should be a law if you flee the scene of an accident you are presumed under the influence. An attorney leaving the scene at that time of night certainly smells like DUI.
